AI and copyright

It’s reasonable to demand a solution for AI copyright infringements, but nobody seems to mention that humans producing original content are also “inspired” by copyrighted material.

Taking inspiration is the human version of AI training. AI misses the legal awareness that would make us draw a “videogame plumber” that is original, although inspired by Mario.

We grow up immersed in copyrighted content, and we study design, art, music, and literature, before starting a career in the same sectors. Take characters like Donald Duck, Duffy Duck, Howard the Duck, or Count Duckula. Can we say that they are all 100% original?

There is no doubt that generative AI will avoid plagiarism at some point. The real problems others:

  • Is it fair to use copyrighted material without permission to train a model and make money?
  • Is it in the best interest of humanity to limit groundbreaking technology like AI to protect copyright?
  • Who should own models?
